from all sources shall be maintained and managed by the appointed single fiscal agent. GCBH, <br />LLC , is appointed to serve as its own single fiscal agent. <br />9.5 Interest on and Return of apita l ontribut io ns . No County Authority shall <br />be entitled to interest on its Capital Contribution or to return of its Capital Contribution, <br />except as otherwise specifically provided for herein. <br />9.6 Acco un ti n g Peri od. The ASO's fiscal year shall be July 1 through June 31. <br />9.7 Records, Audits and Repo rts ; Pu blic Recor d s Requests and H[PAA . At the <br />expense of the ASO, the GCBH, LLC Administrator shall maintain records and accounts of all <br />operations and expenditures of the ASO. All records shall be maintained and be available to <br />the public pursuant to the Washington Public Records Act, chapter 42.56 RCW, chapter 70.02 <br />RCW, the Health Insurance Portability and Accountability Act ("HIPAA"), PL 104-191, as <br />amended and retained pursuant to retention requirements as set forth in RCW Title 40 , <br />WAC 434 and schedules established by the Washington Secretary of State, all as may be <br />amended from time to time. At the minimum the ASO shall keep at its principal place of <br />business the following records: <br />(a) A current list and past list, setting forth the full name and contact <br />information for each County Authority and each County Authority <br />representative serving on the Executive Committee; <br />(b) A current list and past list, setting forth the full name and contact <br />information for each representative sitting on the Advisory Board; <br />(c) A copy of the Certificate of Formation and all amendments thereto; <br />(d) Copies of this Agreement and all amendments hereto; <br />( e) Minutes of the County Authority meeting and any written consents <br />obtained from County Authorities for actions taken by County <br />Authorities without a meeting; <br />(f) Copies of the ASO's financial statements for the seven (7) most <br />recent years; and <br />(g) Its Public Records Policy and Procedures and the name or job title <br />and contact information of its Public Records Officer. <br />All records related to the ASO shall be available for inspection and photocopying under <br />the provisions of the Washington Public Records Act, chapter 42.56 RCW ("PRA"), subject <br />to any exemptions or limitations on disclosure. At the expense of the ASO, the ASO shall <br />adopt a public records policy in compliance with the PRA to respond to public records <br />requests received by the ASO. <br />FIRST AMENDED ASO OPERA TING AGREEMENT <br />Page 19 of33
