3.9 INSURANCE <br />3.9.1 HCA certifies that it is self-insured under the State's self-insurance liability <br />program, as provided by RCW 4.92.130, and shall pay for losses for which is <br />found liable. <br />3.9.2 The Contractor certifies by signing this Agreement that either: <br />3.9.2.1 The Contractor is self-insured or insured through a risk pool and <br />shall pay for losses for which it is found liable, or <br />3.9.2.2 The Contractor maintains the types and amounts of insurance <br />identified below and shall, if requested by HCA; provide <br />certificates of insurance to that effect to the HCA contact on <br />page one of the Agreement. <br />3.9.2.2.1 Commercial General Liability Insurance Policy -to <br />include coverage for bodily injury, property damage, <br />and contractual liability, with the following minimum <br />limits: Each occurrence -$1,000,000; General <br />Aggregate -$2,000,000. The policy shall include <br />liability arising out of premises, operations, <br />independent contractors, products-completed <br />operations, personal injury, advertising injury, and <br />liability assumed under an insured agreement. The <br />state of Washington, HCA, its elected and appointed <br />officials, agents, and employees shall be named as <br />additional insureds. Additionally, Contractor is <br />responsible for ensuring that any Subcontractors <br />provide adequate insurance coverage for the <br />activities arising out of subcontracts. <br />3.9.2.2.2 Professional Liability (PL) Insurance. The Contractor <br />shall maintain Professional Liability Insurance or <br />Errors & Omissions insurance, including coverage for <br />losses caused by errors and omissions, with the <br />following minimum limits: Each Occurrence - <br />$1,000,000; Aggregate-$2,000,000. <br />3.10 BACKGROUND CHECKS (RCW 43.43, WAC 388-877 & 388-8778) <br />Contractor shall follow the requirements below and ensure this information is included in all <br />subcontracts: <br />a) Contractor shall ensure a criminal background check is conducted for all staff members, <br />including but not limited to, treatment staff members, prevention staff members, case <br />managers, outreach staff members, etc. or volunteers who have unsupervised access to <br />Washington State <br />Health Care Authority Page 18 of90 HCA Contract No. K3924
