7. OWNERSHIP OF DOCUMENTS. Upon completion of the work, all documents, exhibits, photographic negatives 1 or other presentations of the work shall become the property of the CITY for use without restriction and without representation as to suitability for reuse by any other party unless specifically verified or adapted by the CONSUL TANT. However, any alteration of the documents, by the CITY or by others acting through or on behalf of the CITY, will be at the CITY's sole risk. 8. NONDISCRIMINATION. The CONSUL TANT shall conduct its business in a manner, which assures fair, equal and non-discriminatory treatment of all persons, in particular: 8.1 ~ . The CONSUL TANT shall maintain open hiring and employment practices and will welcome applications for employment in all positions, from qualified individuals who are members of minorities protected by federal equal opportunity/affirmative action requirements; and, 8.2. The CONSUL TANT shall comply with all requirements of applicable federal, state or local laws or regulations issued pursuant thereto, relating to the establishment of non-discriminatory requirements in hiring and employment practices and assuring the service of all persons without discrimination as to any person's race, creed, color, religion, national origin, status as a military veteran, marital status, gender, sexual orientation, disability c,r other legally protected classification. 9. SUBCONTRACTING. 'I · 9.1. ; The CONSUL TANT shall not sublet or assign any of the work covered by this Agreement without the written consent of the CITY. 9.2. In all solicitation either by competitive bidding, RFP process, or negotiation made by the CONSUL TANT for work to be performed pursuant to a subcontractor, including procurement of materials, equipment, website maintenance or marketing services, each potential subconsultant or supplier shall be notified by the CONSUL TANT of CONSUL TANT's obligations under this Agreement, including the nondiscrimination requirements. The CONSUL TANT shall solicit competitively for services or.subcontra;cts that are in excess of ($15,000) dollars. 9.3. -In performing this Agreement, the CONSUL TANT shall not subcontract with or employ any CllY employee without the CITY's written consent. · 10. SUPERVISION, INSPECTION AND PERFORMANCE. 10.1. Even though CONSUL TANT is an independent contractor with the authority to control and direct the performance and details of the 'Services, the Services must meet the approval of CITY and shall be subject to CITY's general right of inspection and supervision to secure the satisfactory completion of this Agreement.
