Filed for Record 04/16/2009 04 :48 :53 PM -Kittitas County, WA Auditor-200904160090 Page 39 of 118 <br />pursuant to Sections 5. l(b) and 5.1 (c) above; provided, however, that: (i) a Site Development <br />Plan which is consistent with the MountainStar Resort Conceptual Master Plan and the <br />Development Agreement or an approved General Site Plan and a Site Development Plan which <br />deviales from the Conceptual Master Plan or the De~elopment Agreement or, alternatively, and <br />if applicable, from an approved General Site Plan in an insignificant way(s) may be reviewed <br />and approved by the BOCC without Planning Commission review; and (ii) a Site Development <br />Plan which deviates from the Conceptual Master Plan or the Development Agreement or, <br />altemativcly, and if applicable, from an approved General Site Plan in significant way(s) shall be <br />reviewed and acted upon by the BOCC following the process set forth in Section 5.l(c) above. <br />(e) Amendment to Conceptual Master Plan, Development Agreement or <br />Approved Ge-neral Site Plan or Site Development Piao. Proposed amendments to the <br />MountainStar Resort Conceptual Master Plan. the Development Agreement or an approved <br />General Site Plan or Site Development Plan shall be submitted and reviewed as set forth in <br />Sections 5. l(b), (c) and (d) and in Section 6. <br />(t) E ffect of Approval. Approval by the County of a General Site Plan will <br />constitute County approval of the general site plan set forth in such General Site Plan, including <br />but not limited to matters such as areas and types ofland use, general location of roadways. open <br />space. recreational facilities and amenities, and overall relationship to adjacent areas of <br />MountainStar. Approval by the County ofa Site Development Plan will constitute County <br />approval of the specific site plan set forth in such Site Development Plan, and shall serve as <br />authorization to construct Utilities provided for in that Site Development Plan and other <br />improvements that do not require building or construction permits under the County Code. <br />Approval of a Site Development Plan shaJI also serve as authorization for the submission of <br />Sunc.aclia Masler Planned Resort Development Aim:i;mCJJl lAmendt.-d and Restat.ed !2--02-200Sl Poge 311
