Filed for Record 04/16/2009 04:48:53 PM - Kittitas County, WA Auditor - 200904160090 Page 107 of 118 <br />EXHBIT J (Rev. 1) to Development Agreement <br />Development Standards and Design Guidelines for <br />MountainStar Master Planned Resort <br />December 2, 2008 <br />Section 3 - Roads and Non -motorized Facilities <br />The purpose of this section is to provide a foundation for the development of an integrated, fully <br />accessible transportation system that addresses the goals and vision of MountainStar. The <br />components of this transportation system include: <br />➢ Roadways. <br />➢ Multimodal trails. <br />➢ Nature trails. <br />➢ Golf course paths. <br />➢ Equestrian trails. <br />These Development Standards address standards for the proposed private roadways, multimodal, <br />nature and equestrian trails, and golf course paths within MountainStar. <br />All private on-site and public off-site road improvements and paths and trails constructed within <br />or in conjunction with MountainStar shall be in accordance with Kittitas County Code Chapters <br />12. l 0, 12.20, and 12.30 of the Applicable Law as set forth in the Development Agreement except <br />as specifically modified herein. Consistent with MountainStar MPR Condition C-12, gates will <br />be allowed to control or close access to roads, trails and paths at the discretion of the Resort and <br />consistent with the MountainStar MPR Conditions, The Resort will establish design criteria and <br />prepare designs for gates. <br />Paths and trails shall be allowed as shown in Table 2. General Considerations <br />Drainage plans for private roadways within MountainStar are intended to be consistent with the <br />Master Drainage Plan, MountainStar Master Planned Resort, April 1999 (Rev. July 1999). <br />For all MountainStar purposes hereunder, "Private Street" shall be defined as follows: "A <br />privately owned and maintained access provided by a tract, easement or other legal means." <br />Roadway Classification and Design Criteria <br />Notwithstanding any provisions seemingly to the contrary contained within the Road <br />Classification provisions set forth in KCC 12.20.010 and Table 1 below, all roads within <br />MountainStar shall be classified as rural. Thickened wedged asphalt curbs or their functional <br />equivalent may be used to convey stormwater on all such roads in lieu of roadside ditches. <br />The Design Criteria for Rural Access and Private Streets and Roads table as set forth in KCC <br />12.20.050 is hereby modified to delete the Row "A" classification provisions regarding "Serving <br />Potential Number of Single Family Units" as set forth in Table 1. <br />The following provisions of KCC 12.20.080 of the Applicable Law regarding Private Roads <br />shall be inapplicable to MountainStar: KCC 12.20.080(B)(2), (4), (6), (7), (8), (9) and (11) and <br />KCC 12.20.080(D). <br />The provisions of KCC 12.20.100 of the Applicable Law regarding Cul-de-sacs shall be <br />5uncadia ;Master Planned Resort _ Exhibit J - Development Standards <br />2 December 2, 2008 <br />
