<br /> <br /> <br /> <br />Page 114 <br />l) Depth of the overburden; <br />m) Physical properties of the resource including quality and type; <br />n) Life of the resource; <br />o) Resource availability in the region; <br />p) Long-term economic conditions which affect the ability to manage and/or maintain commercially viable <br />mineral lands of long-term commercial significance, which should include consideration of the <br />following market factors: <br /> The location of manufacturing or processing facilities, <br /> Equipment and transport costs, <br /> Site productivity and production costs, <br /> Taxes and administrative costs. <br />De-designation <br />Kittitas County, hereby adopts the following provision with respect to de-designation of mineral resource <br />land: <br />1) Change in circumstances pertaining to the comprehensive plan or public policy; <br />2) A change in circumstances beyond the control of the landowner pertaining to the subject property; <br />3) An error in designation; or <br />4) New information on natural resources land or critical area status. <br />In considering any one of these elements, the criteria for designation should additionally be considered. <br />Areas meeting the criteria for Mineral Lands of Long- Term Commercial Significance and classified as such, <br />including future discoveries, are designated on the final Comprehensive Plan map and included in the final <br />Comprehensive Plan. The map shows the location of Mineral Lands of Long-Term Significance and will be <br />updated and amended as new mining sites, meeting the designation criteria, are approved. <br />RR-P149: The County should allow for extraction of mineral resources where such extraction does not <br />significantly impact other natural resources. <br />RR-P150: When the County reviews proposed new land uses that have the potential to conflict with <br />commercial mining activities, such as residential subdivisions, consideration of both surface and mineral <br />rights ownership should be included in the review. <br />RR-P151: New uses, such as residential and commercial uses, conflicting with existing commercial mining <br />activities in designated mineral resource areas shall be required to locate away from such mining activities. <br />RR-P152: The County shall require that all plats, short plats, development permits, and building permits <br />issued for development activities on, or within five hundred feet of, lands designated as mineral resource <br />lands, shall contain a notice that states that: “The subject property is within or near designated mineral <br />resource lands on which a variety of commercial activities and mineral operations may occur that are not <br />compatible with residential development for certain periods of limited duration. Commercial natural <br />resource activities and/or mineral operations performed in accordance with County, State and federal laws <br />are not subject or legal action as public nuisances.”
