2018 Docket Enabling Ordinance December 18, 2018 <br />Page 17 <br /> <br />Exhibit B: Amendment 18-02 <br /> <br />Amendments to KCC Title 15A regarding permit <br />expiration time limit <br /> <br />15A.03.045 Permit processing time. <br />1. Once an application has been deemed complete, the Director may request the applicant to submit additional <br />corrections, studies or other information on the proposed project. The Director shall set a reasonable <br />deadline for the submittal of corrections, studies or other information when requested, and shall provide <br />written notification of such requests to the applicant. <br />2. Failure by the applicant to meet such deadline shall be cause for the application to be void. However, an <br />extension of such deadline may be requested by an applicant if the request is made prior to the expiration of <br />the deadline. Extension requests shall be submitted in writing, include a justification of why an extension is <br />warranted, and include an extension fee, to be determined through resolution. <br />3. When considering a request for a deadline extension, the Director shall give consideration to the code <br />provisions to which the project is vested, if any. In order to assure equity in permit processing between past, <br />current, and future applicants, deadline extensions shall be limited to one extension after code provisions <br />affecting the project have changed. Once code provisions have changed as to make the vested code <br />substantially different than current code, a requested deadline extension of up to six months may be <br />granted, but it shall be the final extension granted. The Director shall determine whether code changes have <br />created substantially different regulations. <br />4. The Director shall provide a written, mailed response to the applicant with its decision on each extension <br />request. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
