• It is a part of a larger proposal that is subject to SEPA for other reasons (e.g., the need to obtain <br />other permits that are not exempt from SEPA); <br />• It is part of a series of exempt actions that, together, trigger the need to do a threshold <br />determination, as defined under WAC 197-11-305. <br />This application is subject to environmental review under SEPA. The application requests a change in <br />quantities greater than 2,250 gpm (1 cfs). Additionally, land use decisions related to the permitted uses <br />and previous SEPA decisions associated with the County's Water Bank are not exempt. <br />Kittitas County acted as lead agency for the SEPA review for the proposal. A checklist was completed <br />and a Mitigated Determination of Non-Significance (MDNS) was issued by the County. Notice of the <br />MDNS was published in the Daily Record, Ellensburg, Kittitas County, Washington on February 5, 2018 <br />and February 12, 2018. No action was taken on this application for 14 days following the publication of <br />the determination per WAC 197-11-340. <br />Public Notice <br />RCW 90.03.280 requires that notice of a water right application be published once a week, for two <br />consecutive weeks, in a newspaper of general circulation in the county or counties where the water is to <br />be stored, diverted, and used. Notice of this application was published in the Ellensburg Daily Record on <br />February 7th and 14th, 2018. <br />Consideration of Protests <br />No protests to this water right application were received. <br />Consideration of Comments <br />No comments regarding this water right application were received. <br />Other Public Interest Concerns <br />Pursuant to RCW 90.42.040(4)(a) exercise of a trust water right may be authorized only if the <br />department first determines no detriment to the public interest. Ecology considered how the change in <br />purpose and acceptance into the TWRP will affect an array of factors such as wildlife habitat, recreation, <br />water quality, and human health. The environmental amenities and values associated with the area <br />were taken into account during the consideration of this change application. Consideration of these <br />factors allows the author to reach the conclusion that this transfer will not be detrimental to the public <br />interest. <br />Conclusions <br />l find that the right to be 'changed is valid, and the change will not impair existing rights. <br />RECOMMENDATIONS <br />Based on the above investigation and conclusions, I recommend the request to change this water right <br />be approved in the amounts and within the limitations listed below and subject to the provisions listed <br />above. <br />Primary Reach <br />1.08 cfs, 249.42 acre-feet/year for the purposes of instream flow and mitigation for out-of-priority uses <br />from March 15 to September 15, within Cooke Creek from the historical upstream point of diversion <br />Change Report of Examination Page 12 of 15 Water Right File No. CS4-01141sb10
