A15 DRUG FREE WORKPLACE REQUIREMENTS <br />A15.1 <br />49 CFR part 32 <br />SOURCE <br />Drug-Free Workplace Act of 1988 (41 U.S.C. 701 et seq., as amended) <br />A15.2 APPLICABILITY <br />The Drug-Free Workplace Act of 1988 requires some Federal contractors and all Federal grantees to <br />agree that they will provide drug-free workplaces as a condition of receiving a contract or grant from a <br />Federal agency. The Act does not apply to contractors, subcontractors, or subgrantees, although the <br />Federal grantees workplace may be where the contractors, subcontractors, or subgrantees are working. <br />Contract Types -This provision applies to all AIP funded projects, but not to the contracts between the <br />grantee (the sponsor) and a contractor, subcontractors, suppliers, or subgrantees. <br />Use of Provision -No mandatory or recommended text provided because the requirements do not <br />extend beyond the sponsor level. <br />AlS.3 CONTRACT CLAUSE <br />None. <br />Guidelines for Contract Provisions for Obligated Sponsors and Airport Improvement Program Projects <br />Issued on December 12, 2017 Page 43
