AS CIVIL RIGHTS -GENERAL <br />AS.l SOURCE <br />49 USC§ 47123 <br />AS.2 APPLICABILITY <br />There are two separate civil rights provisions that apply to projects: <br />1. FAA General Civil Rights Provision and, <br />2. Title VI provisions, which are addressed in Appendix AG. <br />Contract Types -The General Civil Rights Provisions found in 49 USC§ 47123, derived from the Airport <br />and Airway Improvement Act of 1982, Section 520, apply to all sponsor contracts regardless of funding <br />source. <br />Use of Provision -MANDATORY TEXT. There are two separate general civil rights provisions -one that <br />is used for contracts, and one that is used for lease agreements or transfer agreements. The sponsor <br />must incorporate the text of the appropriate provision without modification into the contract, or the <br />lease or transfer agreement. <br />AS.3 CONTRACT CLAUSE (Use the Correct Clause for the Situation) <br />AS.3.1 Clause that is used for Contracts <br />GENERAL CIVIL RIGHTS PROVISIONS <br />The Contractor agrees to comply with pertinent statutes, Executive Orders and such rules as are <br />promulgated to ensure that no person shall, on the grounds of race, creed, color, national origin, sex, <br />age, or disability be excluded from participating in any activity conducted with or benefiting from <br />Federal assistance. <br />This provision binds the Contractor and subcontractors from the bid solicitation period through the <br />completion of the contract. This provision is in addition to that required by Title VI of the Civil Rights <br />Act of 1964. <br />AS.3.2 Clause that is used for Lease Agreements or <br />Transfer Agreements <br />GENERAL CIVIL RIGHTS PROVISIONS <br />The (tenant/concessionaire/lessee) agrees to comply with pertinent statutes, Executive Orders and such <br />rules as are promulgated to ensure that no person shall, on the grounds of race, creed, color, national <br />origin, sex, age, or disability be excluded from participating in any activity conducted with or benefiting <br />from Federal assistance.
