A23 SEISMIC SAFETY <br />A23.1 SOURCE <br />49 CFR part 41 <br />A23.2 APPLICABILITY <br />Contract Types —This provision applies to construction of new buildings and additions to existing <br />buildings financed in whole or in part through the Airport Improvement Program. <br />Professional Services—Sponsor must incorporate this clause in any contract involved in the <br />construction of new buildings or structural addition to existing buildings. <br />Construction — Sponsor must incorporate this clause in any contract involved in the construction <br />of new buildings or structural addition to existing buildings. <br />Equipment— Sponsor must include the construction provision if the project involves <br />construction or structural addition to a building such as an electrical vault project to <br />accommodate or install equipment. <br />Land— This provision will not typically apply to a property/land project <br />Use of Provision — No mandatory text provided. The following language is acceptable to the FAA and <br />meets the intent of this requirement. If the sponsor uses different language, the sponsor's language <br />must fully satisfy the requirements of 49 CFR part 41. <br />A23.3 CONTRACT CLAUSE <br />A23.3.1 Professional Service Agreements for Design <br />SEISMIC SAFETY <br />In the performance of design services, the Consultant agrees to furnish a building design and associated <br />construction specification that conform to a building code standard that provides a level of seismic <br />safety substantially equivalent to standards as established by the National Earthquake Hazards <br />Reduction Program (NEHRP). Local building codes that model their building code after the current <br />version of the International Building Code (IBC) meet the NEHRP equivalency level for seismic safety. <br />At the conclusion of the design services, the Consultant agrees to furnish the Owner a "certification of <br />compliance" that attests conformance of the building design and the construction specifications with the <br />seismic standards of NEHRP or an equivalent building code. <br />A23.3.2 Construction Contracts <br />SEISMIC SAFETY <br />The Contractor agrees to ensure that all work performed under this contract, including work performed <br />by subcontractors, conforms to a building code standard that provides a level of seismic safety <br />substantially equivalent to standards established by the National Earthquake Hazards Reduction <br />Guidelines for Contract Provisions for Obligated Sponsors and Airport Improvement Program Projects <br />Issued on December 12, 2017 Page 60 <br />
