A18 LOBBYING AND INFLUENCING FEDERAL EMPLOYEES <br />A18.1 SOURCE <br />31 USC § 1352 — Byrd Anti -Lobbying Amendment <br />2 CFR part 200, Appendix II(J) <br />49 CFR part 20, Appendix A <br />A18.2 APPLICABILITY <br />Consultants and contractors that apply or bid for an award of $100,000 or more must certify that it will <br />not and has not used Federal appropriated funds to pay any person or organization for influencing or <br />attempting to influence an officer or employee of any agency, a member of Congress, officer or <br />employee of Congress, or an employee of a member of Congress in connection with obtaining any <br />Federal contract, grant, or another award covered by 31 USC 1352. Each tier must also disclose any <br />lobbying with non -Federal funds that takes place in connection with obtaining any Federal award. <br />Contract Types —The sponsor must incorporate this provision into all contracts exceeding $100,000. <br />Use of Provision — MANDATORY TEXT. Appendix A to 49 CFR Part 20 prescribes language the sponsor <br />must use. The sponsor must incorporate this provision without modification. <br />A18.3 CONTRACT CLAUSE <br />CERTIFICATION REGARDING LOBBYING <br />The Bidder or Offeror certifies by signing and submitting this bid or proposal, to the best of his or her <br />knowledge and belief, that: <br />(1) No Federal appropriated funds have been paid or will be paid, by or on behalf of the Bidder or <br />Offeror, to any person for influencing or attempting to influence an officer or employee of an <br />agency, a Member of Congress, an officer or employee of Congress, or an employee of a <br />Member of Congress in connection with the awarding of any Federal contract, the making of <br />any Federal grant, the making of any Federal loan, the entering into of any cooperative <br />agreement, and the extension, continuation, renewal, amendment, or modification of any <br />Federal contract, grant, loan, or cooperative agreement. <br />(2) If any funds other than Federal appropriated funds have been paid or will be paid to any person <br />for influencing or attempting to influence an officer or employee of any agency, a Member of <br />Congress, an officer or employee of Congress, or an employee of a Member of Congress in <br />connection with this Federal contract, grant, loan, or cooperative agreement, the undersigned <br />shall complete and submit Standard Form -LLL, "Disclosure Form to Report Lobbying," in <br />accordance with its instructions. <br />(3) The undersigned shall require that the language of this certification be included in the award <br />documents for all sub -awards at all tiers (including subcontracts, subgrants, and contracts under <br />Guidelines for Contract Provisions for Obligated Sponsors and Airport Improvement Program Projects <br />Issued on December 12, 2017 Page 52 <br />
