4. LIABILITY COVERAGE PROVISIONS <br />a. Each Party to this Agreement will be responsible for the negligent acts or <br />omissions of its own employees, officers, or agents in the performance of this <br />Agreement. Neither Party will be considered the agent of the other and neither <br />Party assumes any responsibility to the other Party for the consequences of any <br />act or omission of any person, firm, or corporation not a party to this Agreement. <br />For purposes of liability and indemnification, students participating in the clinical <br />education program are considered agents of HU. <br />HU and its officers, employees, and agents, while acting in good faith within the <br />scope of their official HU duties, are covered by the State of Washington Self- <br />Insurance Program and the Tort Claims Act CRCW 4.92.060 et seq.), and <br />successful claims against HU and its employees, officers, and agents in the <br />performance of their official HU duties in good faith under this Agreement will be <br />paid from the tort claims liability account as provided in RCW 4.92.130. <br />b. Training Site maintains professional liability coverage that provides liability <br />coverage for its employees, officers, and agents in the performance of this <br />Agreement, and further provides the means for defense and payment of claims <br />that may arise against such individuals. Training Site shall provide proof of such <br />insurance to HU upon request. <br />c. Training Site will accept placement of only those students who are insured against <br />liability for actions or inactions occurring in the clinical setting. Students <br />participating in the clinical education program will be covered either by a student <br />medical malpractice policy offered through Heritage University, or acquired by <br />the student through another source. The limits of such coverage shall be, at a <br />mlmmum, $1,000,000 per occurrence/$3,000,000 aggregate. Mandatory <br />certificates of such coverage purchased by the student will be provided to <br />Training Site .. Should proof of insurance not meet with Training Site's approval <br />and satisfaction, Training Site can refuse to accept any student for placement. <br />5. TERM AND TERMINATION <br />a. This Agreement is effective upon execution by the Parties and will continue <br />thereafter from academic year to academic year unless terminated as provided in <br />this Agreement. However, Parties shall review this Agreement no later than three <br />years from its effective date or earlier at the request of either party. <br />b. HU and Training Site will jointly plan student placement in advance of the <br />beginning of the clinical education experience, taking into account the needs of <br />the HU for clinical placement, the maximum number of students for whom <br />Training Site can provide a desirable clinical education experience, and the needs <br />of other disciplines requesting clinical placements. <br />HERITAGE UNIVERSITY BSN PROGRAM STUDENT CLINICAL SITE AFFILIATION AGREEMENT 6
