N. The changes in the Code will improve the health and safety for future development. <br />v. The change meets the Growth Management Act and the objectives of the Comprehensive <br />Plan. <br />16-02 Kittitas County Proposal: <br />Amend KCC Section 14.04.020 to Recognize Private Recorded Easements when Evaluating <br />Building Permits, Exhibit B. <br />The Board of County Commissioners proposes amending KCC 14.04.020 related to minimum <br />submittal requirements. The amendment would require the submittal of easements recorded with the <br />Auditor with permit application documents so that such easements, whether public or private, would <br />be recognized with the siting of the building. <br />The Board of County Commissioners held a public hearing on November 28, 2016, to allow public testimony <br />and approved the request as presented with a 3-0 vote fmding that: <br />I. The Planning Commission recommended approval to the Board of County Commissioners with a <br />vote of4-0. <br />II. Public testimony for this proposal was received testifying against the proposal. <br />III. The County has a responsibility to recognize identified easements. <br />N. Easement documentations are the responsibility of the applicant and easements will have to <br />be recorded with the Auditor. <br />Y. The change meets the Growth Management Act and the objectives of the Comprehensive <br />Plan. <br />16-03 Kittitas County Proposal: <br />Amend Sections ofKCC Title 16 to Place Responsibility for Development of Open Spaces Upon <br />the Developer and/or Land Owner, Exhibit C. <br />Kittitas County Development Services proposes amending KCC Title 16 Subdivisions to place <br />responsibility for development of open spaces upon the developer and/or land owner. <br />The Board of County Commissioners held a public hearing on November 28,2016, opening the public <br />hearing to allow public testimony. Hearing none, the Board of County Commissioners approved the <br />request with amendment with a 3-0 vote finding that: <br />I. The Planning Commission recommended approval to the Board of County Commissioners with a <br />vote of4-0. <br />II. No public testimony for this proposal was received. <br />III. Language in the amendment needs to be added to allow flexibility for improvement of open <br />space having improvements greater than $100,000 designed for the benefit of the residents. <br />N. The language ofthe amendment as amended protects the Kittitas County public from <br />carrying the burden of maintaining open space created by private developers. <br />V.
