<br />H. P ublicatIo n of MAte ria l. Personal injury or
<br />advertising injury arising out of:
<br />I. Oral or written publication of material if done
<br />by or at the direction of the protected pa'rty with
<br />knowledge of its falsity, or
<br />2. Oral or written publication of material whose
<br />first publication took place before the beginning of
<br />the MLC period.
<br />However, any fact pertaining to anyone protected
<br />party shall not be imputed to any other protected party
<br />for th~ purpose of determining the application of this
<br />exclusIOn.
<br />I. R evenue Refunds. Refund of taxes, fees or
<br />assessments.
<br />J. P u n ilive Damages. Liability for punitive or
<br />exemplary damages, except to the extent that the
<br />member county is legally liable therefore because of
<br />the conduct of its officers, employees or voiunteers. The
<br />exception to this exclusion does not apply to any
<br />agreement by a member county, pursuant to RCW
<br />4.96.041 or otherwise, to pay an award for punitive or
<br />exemplary damages entered against an officer,
<br />employee, volunteer or any other individual or
<br />organization other than the member county itself.
<br />K. .I mpl'operrinancial Ga·il1. Liability arising in whole,
<br />or m part, out of any protected party obtaining
<br />remuneration or financial gain to which the protected
<br />part~ .was not legally entitled. However, any fact
<br />pertammg to anyone protected party shall not be
