OocuSign Envelope to: 78COO 188-656B-44E9-9F46-9AFBF222884F <br />99) "Operating Expense" means those costs incurred by the Contractor to perform <br />business activities and includes both Direct Costs and Indirect Costs. Only operating <br />expenses necessary to operate the Contractor's MAC program are allowable for FFP <br />reimbursement. <br />hh) "Potential Medicaid Client" means a Washington resident who may be determined by <br />HCA to meet the eligibility criteria for enrollment in Medicaid. <br />ii) "Random Moment Time Study (RMTS)" or "System" or "Time Study" means an <br />electronic System that quantifies the daily activities of eligible time study Participants <br />through a statistically valid sampling methodology and allocates allowable participant <br />costs to the MAC program. The System calculates the amount of FFP reimbursement <br />based on the Contractors RMTS results, staff costs, MER, costs and other applicable <br />calculations as described in the CAP, manual and this Agreement. <br />jj) "Regulation" means any federal, state, or local Regulation, rule, or ordinance. <br />kk) "RMTS Consortium" "RMTS Consortia" or "Consortium" or "Consortia" means a group <br />of Contractors who have organized together based on similar duties their staff perform, <br />organizational structure, type of programs, scope of work, or regional working <br />relationships and will participate in a single time study together in order to achieve <br />statistical validity. <br />11) "RMTS Coordinator" means an employee(s) of the Contractor who is assigned to be <br />the time study liaison between HCA and the Contractor for purposes of this <br />Agreement. The contractor may assign the fiscal and RMTS coordinator roles to the <br />same staff if desired. <br />mm) "Skilled Professional Medical Personnel" or "SPMP" means an individual who has <br />completed a two-or-more-year program leading to an academic degree or certificate in <br />a medically related profession, demonstrated by possession of a medical license, <br />certificate or other document issued by a recognized National or State medical <br />licensure or certifying organization or a degree in a medical field issued by a college or <br />university certified by a professional medical organization. <br />nn) "State Fiscal Year" means a twelve-month period beginning on July 1 st of one <br />calendar year and ending on June 30th of the following calendar year. <br />00) "State Medicaid Plan" means the comprehensive written commitment by HCA, <br />submitted under 1902(a) of the Social Security Act and approved by the Centers for <br />Medicare and Medicaid Services, to administer or supervise administration of a <br />Medicaid program in accordance with Federal and state requirements. <br />pp) "Subcontract" means any separate agreement or contract between the Contractor and <br />an individual third party or entity ("Subcontractor") to perform all or a portion of the <br />duties and obligations that the Contractor is obligated to perform pursuant to this <br />Contract. <br />qq) "Subunit" means individual cost centers or budget units within a claiming unit (LHJ) <br />State of Washington <br />Health Care Authority <br />Page 26 of 42 HCA Contract No. K1407-1
