No penalty will accrue to HCA in the event this <br />section is exercised. This Section shall not be construed so as to permit HCA to <br />terminate this Contract in order to acquire similar Services from a third party. <br />3.42 WAIVER <br />Waiver of any default shall not be deemed to be a waiver of any subsequent default.
