6.8 Employees will not be required to unwillingly submit to a polygraph test; however, this <br />provision does not apply to the initial application for employment, an employee who has <br />applied for a change in his classification, or to the classifications of Lieutenant, Commander, or <br />higher. Provided, further, if the Sheriff offers an employee the opportunity to take the <br />polygraph test regarding potential involvement in criminal activity or the potential for <br />disciplinary action, the employee after consulting with the Union may agree to a stipulated <br />polygraph. <br />ARTICLE 7 -DEFJNJTJONS OF EMPLOYEES <br />7.1 Regular Corrections and Control Room Operator: A regular Corrections Officer is an <br />employee as defined by RCW 41.56.030(13) and employed in compliance with RCW 43.101.220. <br />A regular Corrections Officer or Control Room Operator has been approved by the Civil Service <br />Commission, served the probationary period and is employed on a regular basis. Such <br />employee shall be paid the wage rate and provided the benefits as set forth in the terms and <br />conditions of this Collective Bargaining Agreement. <br />7.2 Regular Security, Transport. Clerical, and Technology Employe es: A regular Security, <br />Transport, Clerical or Technology employee is an employee who has been approved by the Civil <br />Service commission, has served their probationary period and is employed on a regular basis. <br />Such employee shall be paid the wage rate and provided the benefits as set forth in the terms <br />and conditions of this Collective Bargaining Agreement. <br />7.3 Probationary Employee: A probationary employee shall be defined as any new hire that <br />has never been employed by the Employer during the previous twelve (12) calendar months, <br />and is one who has not completed twelve (12) calendar months of service with the Employer <br />since the first day of employment. Probationary employees shall work under the provisions of <br />this Agreement but shall be only on a trial basis, during which period said employee may be <br />discharged without any recourse. The probationary status of an employee who has not <br />attended the Washington State Basic Corrections Training course is addressed in Section 7.4 <br />below. <br />7.4 Probationary Status Limitation: Any probationary employee who, through no fault of <br />their own, is unable to attend and complete the appropriate Washington State Basic <br />Corrections Training course within the probationary period set forth in Section 7.3 above, shall <br />be entitled to the benefits accorded regular employee status with the exception that said <br />employee must satisfactorily complete said appropriate basic Corrections training course within <br />six (6) calendar months from the first day of employment subject to the following conditions: <br />A. Should any employee opt to defer attending the previously referenced course and <br />subsequently be unable to complete said course within six (6) calendar months, the <br />employee's probationary status shall continue until such course is satisfactorily <br />complete, but not later than twelve (12) calendar months from the first (1st) day of <br />employment. <br />Kittitas County Corrections Contract -01/01/16 -12/31/18 Page 5
