Unclassified Service shall not lose his/her permanent Civil Service Status. The employee may <br />request to return to his/her previous position at any time, without prejudice. The move will <br />occur within thirty (30) calendar days, or as mutually agreed. Likewise, the Sheriff may <br />determine that the employee shall be returned to their previous highest ranking Civil Service <br />position at any time, without prejudice. <br />8.6 If the Sheriff decides to fill a new or vacant position, seniority shall be considered <br />provided the applicants are otherwise qualified based upon training, experience, performance <br />and ability as determined by the Sheriff. <br />In the event a specialty assignment becomes available, the Sheriff will determine appointment <br />to said assignment. Specialty assignments may be used as a training opportunity. Employees <br />selected for specialty assignments may request to be removed from the assignment at any <br />time, or may be rotated out at the discretion of the Sheriff at any time, without prejudice. <br />ARTICLE 9 -LAYOFF AND RECALL <br />9.1 In the event of a layoff or reduction in personnel by the Employer, employees will be <br />laid off by classification in reverse order of their seniority, provided that the remaining <br />employees can perform the work in a satisfactory manner as determined by the Sheriff. In the <br />event of a layoff of an employee in the Corrections Sergeant classification, the Sergeant shall be <br />able to bump the least senior Corrections Officer. In the event of a vacancy in the Sheriff's <br />Office, an employee who has been laid off will have the first opportunity to fill said vacancy or <br />vacancies in the order of their seniority, so long as they meet the qualifications of the position. <br />The last employee laid off will be the first person recalled. Recall rights are valid for the period <br />twelve (12) months following the layoff or reduction in personnel. Notification of eligibility shall <br />be by registered or certified mail to the employee's last known address. An employee shall <br />have fourteen (14) calendar days from the date of mailing to give notice of accepting or <br />rejecting re-employment, and shall be back on the job within fourteen (14) calendar days of <br />accepting said offer, not to exceed thirty (30) days total from date of mailing to return to work, <br />or forfeit all call-back rights under this article.
