'\ I " ~ <br />Meter will designate one or more employees to coordinate and be accountable for the security <br />program. <br />(b) Protection of Customer Content. Badger Meter will implement reasonable and appropriate <br />measures for the Badger Meter Network designed to help Customer secure the Customer <br />Content against accidental or unlawful loss, access or disclosure in accordance with Badger <br />Meter's Security Standards. Badger Meter may modify its Security Standards from time to time <br />but will continue to provide at least the same level of security as described in the Security <br />Standards as of the Effective Date. The security and data privacy provisions in this Section <br />contain Badger Meter, and its Suppliers entire obligation regarding the security, privacy and <br />confidentiality of the Customer Content. <br />(c) Data Storage. Badger Meter will employ commercially reasonable storage (including <br />backup, archive and redundant data storage) and commercially reasonable precautions to <br />prevent the loss of or alteration of Customer Content, but does not guarantee against any such <br />loss or alteration. Badger Meter will not serve as Customer's official record keeper. Customer <br />will maintain source documents of the Confidential Information (such as billing information) <br />hosted by Badger Meter under this Agreement. <br />(d) Customer Responsibilities. Customer is responsible for properly configuring and using <br />the Service and taking steps to maintain appropriate security, protection and backup of the <br />Customer Content, including but not limited to the use of encryption technology to protect <br />Customer Content from unauthorized access and will perform routine archiving of the Customer <br />Content. Further, Customer is responsible for r e gularly auditing its Authorized Users, and will <br />enact internal procedures to remove Authorized Users from the Service if their job duties change <br />and access is no longer appropriate, or if an Authorized User separates from Customer. <br />(e) Data Transmission Risks. <br />(i) Cellular Transmissions. Badger Meter cellular endpoints conform to the AES256 <br />encryption standards or the latest AES standard in effect. Customer acknowledges that <br />neither Badger Meter nor its Suppliers can guarantee the privacy or security of any cellular <br />transmissions as part of the Service. Customer acknowledges that cellular transmissions are <br />capable of being intercepted by third parties without the knowledge or permission of <br />Badger M et er or its Suppliers. Badger Meter and its Suppliers shall not be liable to <br />Customer, the Authorized Users, the Authorized Consumers or any third party for <br />interception or unauthorized use of any data transmitted through the cellular network, as <br />part of the Service. <br />(ii) Internet Transmissions. Customer acknowledges that security of transmissions over <br />the Internet cannot be guaranteed. Badger Meter is not responsible for: (i) Customer's <br />access to the Internet; (ii) interception, unauthorized use or interruptions of <br />communications through the Internet; or (iii) changes or losses of data through the Internet, <br />©2015 Badger Meter, Inc.
