<br /> 18 <br />Kittitas County Code 17.98.020 <br />29. KCC17.98.020(1): <br /> A petition to amend this title shall be filed with the administrator on forms prescribed by the Director. If <br />the petition is for an amendment to the zoning map it shall include a legal description and location of the <br />property to be reclassified. This criteria has been met. <br />30. KCC17.98.020(2): <br />A petition asking for a change from one zone to another must be signed by not less than seventy-five <br />percent (75%) of the property owners and representing at least seventy-five percent (75%) of the assessed <br />valuation of the area proposed for the zone reclassification. This criteria has been met. <br />31. KCC17.98.020(3): <br />Any member of the general public has the right to petition the Board or planning commission for <br />consideration of text amendments or change from one zone to another for a general area. Such <br />consideration is not mandatory. This criteria has been met. <br />32. KCC17.98.020(4): <br />Petitions shall be processed pursuant to Title 15A of this code, Project permit application process. This <br />criteria has been met. <br /> <br />33. KCC17.98.020(5): <br />A petition requesting a change on the zoning map shall be processed consistently with the Annual <br />Comprehensive Plan Docketing Process, pursuant to KCC Title 15B, unless the petition is consistent with <br />the Comprehensive Plan land use designation of the property and accompanied by a specific development <br />application. This criteria has been met. <br /> <br />34. KCC17.98.020(6): <br />A petition requesting a change on the zoning map from one zone to another must demonstrate that the <br />following criteria are met: <br /> <br /> 34.1 KCC 17.98.020(6)(a): <br />This provision has been primarily met because the proposed amendment is compatible with the <br />comprehensive plan designation of rural residential. As set forth in the Kittitas County <br />Comprehensive Plan, rural residential lands are those adjacent or near to urban growth areas and <br />while they have a lower population density than urban areas, their density is higher than most rural <br />areas. The purpose of rural residential lands are to allow for residential development that has a <br />rural character and a variety of densities without the expectation of all urban services. While <br />commercial activity is not expected, it’s not prohibited. The project being considered is consistent <br />with the Comprehensive Plan. It is primarily a residential development with other uses consistent <br />with rural lands. While there is a general clustering of the residential units, the benefit is <br />substantial open space. While of course there are visual impacts, they are limited due the limited <br />area of land being developed. <br /> <br />
