This NDA contains the entire agreement and understanding of the parties with respect to the <br />subject matter hereof, and supersedes and replaces any and all prior discussions, <br />representations, and understandings, whether oral or written. <br /> <br />9.11 To the extent that the CUSTOMER is a public entity covered by the Washington State Public <br />Disclosure Act (PDA), there is not an ability to use Delaware Law and this agreement as a shield <br />to non-compliance with that law. However, the PDA does have protections for proprietary and <br />confidential information, which protections can/must be sought through court order. Should any <br />public disclosure request received by the CUSTOMER appear to require more than providing <br />our records, and might infringe upon the confidential or proprietary information of equivant, the <br />CUSTOMER will immediately notify equivant of such concern, such that equivant can take legal <br />action under the PDA to secure protections of such information.
