B. The action of the board of adjustment on <br />the application for a conditional use permit or a <br />variance shall be final and conclusive unless <br />appeal is filed by land use petition in a timely <br />fashion. (Ord. 96-19 (part), 1996; Ord. 87-1, <br />1987: Res. 83-10, 1983). <br />17.96.140 Order to include finding of <br />fact. The administrator and board of adjustment <br />shall, in making an order, requirement, decision <br />or determination, include in a written record of <br />the case, the findings of fact upon which the <br />action is based. (Ord. 96-19 (part), 1996; Res. <br />83-10, 1983). <br />Chapter 17.98 <br />AMENDMENTS' <br />Sections: <br />17.98.010 Proposal. <br />17.98.020 Petitions. <br />17.98.010 Proposal. Changes and amend- <br />ments to this title may be proposed by: <br />A. The board of county commissioners; <br />B. The county planning commission; <br />C. Petition of the property owners affected, <br />or their authorized agent. (Res. 83-10, 1983). <br />17.98.020 Petitions. A. A petition to <br />amend this title shall be filed with the adminis- <br />trator on forms prescribed by the planning <br />administrator. If the petition is for an amend- <br />ment to the zoning map it shall include a legal <br />description and location of the property to be <br />reclassified. <br />B. A petition asking for a change from one <br />zone to another must be signed by not less than <br />seventy-five percent of the property owners and <br />representing at least seventy-five percent of the <br />assessed valuation of the area proposed for the <br />zone reclassification. <br />C. Any member of the general public has <br />the right to petition the board of county commis- <br />sioners or planning commission for consider- <br />ation of text amendments or change from one <br />17.96.140 —17.98.020 <br />zone to another for a general areas. Such consid- <br />eration is not mandatory. <br />D. Petitions shall be processed pursuant to <br />Title 15A of this code, Project permit applica- <br />tion process. <br />E. A petition requesting a change on the <br />zoning map from one zone to another must dem- <br />onstrate that the following criteria are met: <br />1. The proposed amendment is compat- <br />ible with the comprehensive plan; and <br />2. The proposed amendment bears a <br />substantial relation to the public health, safety <br />or welfare; and <br />3. The proposed amendment has merit <br />and value for Kittitas County or a sub -area of <br />the county; and <br />4. The proposed amendment is appro- <br />priate because of changed circumstances or <br />because of a need for additional property in the <br />proposed zone or because the proposed zone is <br />appropriate for reasonable development of the <br />subject property; and <br />5. The subject property is suitable for <br />development in general conformance with zon- <br />ing standards for the proposed zone; and <br />6. The proposed amendment will not be <br />materially detrimental to the use of properties in <br />the immediate vicinity of the subject property; <br />and <br />7. The proposed changes in use of the <br />subject property shall not adversely impact irri- <br />gation water deliveries to other properties.
