KITTITAS COUNTY <br />LAND USE HEARING EXAMINER <br />IN THE MATTER OF ) <br />PD -17-00001 ) <br />CU -17-00001 ) ADDITIONAL RECOMMENDED <br />LP -17-00001 ) FINDINGS OF FACT <br />Marian Meadows Project ) <br />26. The Kittitas County Board of Commissioners remanded the above referenced matter to the <br />Hearing Examiner to reopen the record in order to make additional Recommended Findings <br />of Fact regarding whether the project meets the criteria set forth in KCC 17.36.045. <br />27. The Hearing Examiner reopened the record by Order dated January 9, 2018. <br />28. Although the Kittitas County Board of Commissioners remanded this matter to the Hearing <br />Examiner to make Recommended Findings of Facts specifically related to KCC I7,36.045, the <br />Hearing Examiner notes that according to the first criteria set forth in 17.36.045(1)(a)(i) in the <br />evaluation of the project, the decision maker must determine whether or not the PUD complies <br />with all of the amendment criteria in KCC Chapter 17.98. Accordingly, the Hearing Examiner <br />will first review the criteria set forth in KCC 17.98 and then will examine the criteria set forth <br />in KCC 17.36.045(1)(a) and (b). <br />Kittitas County Cotte 17.98.020 <br />29. KCC17.98.020(1): <br />A petition to amend this title shall be filed with the administrator on forms prescribed by the <br />Director. If the petition is for an amendment to the zoning map it shall include a legal <br />description and location of the property to be reclassified. This criteria has been met. <br />30. KCC17.98.020(2): <br />A petition asking for a change from one zone to another must be signed by not less than <br />seventy-five percent (75%) of the property owners and representing at least seventy-five <br />percent (75%) of the assessed valuation of the area proposed for the zone reclassification. This <br />criteria has been met. <br />31. KCC17.98.020(3): <br />Any member of the general public has the right to petition the Board or planning commission <br />for consideration of text amendments or change from one zone to another for a general area. <br />Such consideration is not mandatory. This criteria has been met. <br />32.
