Proposals for buffer averaging shall not require a shoreline variance or <br />compensatory mitigation if the following conditions are met: <br />a. The minimum width of the buffer at any given point is at least seventy five <br />percent (75%) of the standard width per Table 5.5-1, or twenty-five (25) feet, <br />whichever is greater; <br />b. The net buffer area (acreage) after averaging is the same as the buffer area <br />without averaging; and <br />c. The area that is added to the buffer to offset the reduction is well-vegetated. The <br />Administrator may require vegetation enhancement if needed to ensure this <br />criterion is met. <br />6. Where possible, development and uses within the urban conservancy, rural <br />conservancy, and natural designations shall be situated to avoid or minimize impacts <br />to forest habitat and other relatively undisturbed native vegetation communities. <br />5.6 Water quality, stormwater, and nonpoint pollution <br />The following section applies to all uses and development in shorelines of the state, as <br />defined in WAC 173-26-020, that affect water quality. <br />To ensure mutual consistency between shoreline management provisions and other <br />regulations that address water quality and stormwater quantity, including public health, <br />stormwater, and water discharge standards, the regulations that are most protective of <br />ecological functions shall apply. <br />A. Policies <br />1. Prevent impacts to water quality and stormwater quantity that would result in a net <br />loss of shoreline ecological functions, or a significant impact to aesthetic qualities, or <br />recreational opportunities. <br /> <br />2. Maintain or enhance the quantity and quality of surface and ground water over the <br />long term. <br /> <br />3. Shoreline use and development should minimize the need for chemical fertilizers, <br />pesticides or other similar chemical treatments to prevent contamination of surface <br />and groundwater and/or soils and adverse effects on shoreline ecological functions <br />and values. <br /> <br />B. Regulations <br />1. Shoreline use and development shall incorporate measures to protect and maintain <br />surface and groundwater quantity and quality in accordance with all applicable laws. <br /> <br />2. New uses and developments shall provide stormwater management facilities <br />designed, constructed, and maintained in accordance with the current stormwater
