<br />Kittitas County Board of County Commissioners Shoreline Master Program Adopting Ordinance <br />Kittitas County Shoreline Master Program Exhibit D | March 2016 | Page 244 of 339 <br /> <br /> <br />17B.02.435 Shorelands or shoreland areas. <br />"Shorelands" or "shoreland areas" means those lands extending landward for two hundred <br />(200) feet in all directions as measured on a horizontal plane from the OHWM; floodways and <br />contiguous floodplain areas landward two hundred (200) feet from such floodways; and all <br />wetlands and river deltas associated with the streams, lakes, and tidal waters which are subject <br />to the provisions of this chapter; the same to be designated as to location by the Washington <br />State Department of Ecology. <br />1. Any county or city may determine that portion of a one hundred-(100)-year-floodplain to be <br />included in its master program as long as such portion includes, as a minimum, the <br />floodway and the adjacent land extending landward two hundred (200) feet therefrom. <br />2. Any city or county may also include in its master program land necessary for buffers for <br />critical areas, as defined in RCW Chapter 36.70A, that occur within shorelines of the state, <br />provided that forest practices regulated under RCW Chapter 76.09, except conversions to <br />non-forest land use, on lands subject to the provisions of RCW 90.58.030(2)(d)(ii) are not <br />subject to additional regulations under this chapter. <br /> <br />17B.02.440 Shoreline areas and shoreline jurisdiction. <br />"Shoreline areas" and "shoreline jurisdiction" means all "shorelines of the state" and <br />"shorelands" as defined in RCW 90.58.030. <br /> <br />17B.02.445 Shoreline functions. <br />"Shoreline functions" see definition for "ecological functions." <br /> <br />17B.02.450 Shoreline master program. <br />"Shoreline master program" see definition for "Master program." <br /> <br />17B.02.455 Shoreline modifications. <br />"Shoreline modifications" means any human activity that changes the structure, hydrology, <br />habitat, and/or functions of a shoreline. Bulkheads, piers, docks, shoreline stabilization systems, <br />clearing and grading, application of chemicals, berms or significant vegetation removal, and <br />dikes are all examples of shoreline modifications. <br /> <br />17B.02.460 Shorelines. <br />"Shorelines" means all of the water areas of the state, including reservoirs, and their <br />associated shorelands, together with the lands underlying them; except (i) shorelines of <br />statewide significance; (ii) shorelines on segments of streams upstream of a point where the <br />mean annual flow is twenty cubic feet per second (20 cfs) or less and the wetlands associated <br />with such upstream segments; and (iii) shorelines on lakes less than twenty (20) acres in size <br />and wetlands associated with such small lakes. <br /> <br />17B.02.465 Shorelines of statewide significance. <br />"Shorelines of statewide significance" means the shorelines identified in RCW 90.58.030 <br />which because of their elevated status require the optimum implementation of the Shoreline <br />Management Act’s policies. This includes all rivers with a mean annual flow of greater than two <br />hundred cubic feet per second (200 cfs) and lakes with surface areas of one thousand (1,000) <br />acres or more. <br /> <br />17B.02.470 Shorelines of the state. <br />"Shorelines of the state" are the total of all "shorelines" and "shorelines of statewide <br />significance" within the state.
