The location and planning of in-stream structures shall give due consideration to the <br />full range of public interests, watershed functions and processes, and environmental <br />concerns, with special emphasis on protecting and restoring priority habitats and <br />species. <br />3. In-stream structures should be located, designed, constructed and maintained so <br />their resultant effects on geologic or hydrologic shoreline processes will not cause <br />damage to other properties or shoreline resources, and so that the physical integrity <br />of the shoreline process corridor is maintained. <br />4. In-stream structures shall be sited and designed consistent with appropriate <br />engineering principles, including, but not limited to, guidelines of the Natural <br />Resource Conservation Service and the U.S. Army Corps of Engineers. <br />5. Non-structural and non-regulatory methods to protect, enhance, and restore <br />shoreline ecological functions and processes and other shoreline resources should <br />be encouraged as an alternative to in-stream structures. Non-regulatory and non- <br />structural methods may include public facility and resource planning, land or <br />easement acquisition, education, voluntary protection and enhancement projects, or <br />incentive programs. <br />6. Planning and design of in-stream structures should be consistent with and <br />incorporate elements from applicable watershed management and restoration plans <br />and/or surface water management plans. <br />B. Regulations <br />1. Channelization projects that damage fish and wildlife resources, degrade recreation <br />and aesthetic resources, or result in high flood stages and velocities shall not be <br />permitted when feasible alternatives are available. <br />2. Cut-and-fill slopes and backfilled areas shall be stabilized with brush matting and <br />buffer strips and re-vegetated with native grasses, shrubs, or trees to prevent loss of <br />shoreline ecological functions and processes. <br />3. In-stream structures shall be constructed and maintained in a manner that does not <br />degrade the quality of affected waters. The jurisdictions may require reasonable <br />conditions to achieve this objective, such as setbacks, buffers, or storage basins. <br />4. Natural in-stream features such as snags, uprooted trees, or stumps should be left in <br />place unless it can be demonstrated that they are causing significant bank erosion or <br />higher flood stages, or pose an unavoidable hazard to navigation. <br />5. In-stream structures shall allow for natural groundwater movement and surface <br />runoff.
