Allow filling, grading, and excavation within the OHWM only <br />when necessary to support water dependent uses, public access, transportation <br />facilities, mitigation, restoration, enhancement, and other uses listed in 6.8.B.2. <br /> <br />3. In evaluating filling, grading, and excavation projects, such factors as total water <br />surface reduction, navigation restriction, impediment to water flow and circulation, <br />impediment to irrigation systems, reduction of water quality, and destruction of fish <br />and wildlife habitat should be examined. <br /> <br />4. Locate and design shoreline fills or cuts to avoid creating a hazard to adjacent life, <br />property, and natural resources systems, and to provide all perimeters of fills with <br />vegetation, retaining walls, or other mechanisms for erosion prevention. <br />B. Regulations <br />1. Filling, grading or excavation waterward of the OHWM for any use except ecological <br />restoration shall require a conditional use permit. <br />2. Fill waterward of the OHWM shall be allowed with a shoreline conditional use permit <br />only when necessary to support: <br />a. Water-dependent use; <br />b. Public access; <br />c. Cleanup and disposal of contaminated sediments as part of an interagency <br />environmental clean-up plan; <br />d. Disposal of dredged material considered suitable under, and conducted in <br />accordance with the dredged material management program of the <br />Washington State Department of Natural Resources; <br />e. Expansion or alteration of transportation facilities of statewide significance <br />currently located on the shoreline and then only upon a demonstration that <br />alternatives to fill are not feasible; or <br />f. Mitigation action, environmental restoration, or enhancement project. <br /> <br />3. Fill for the purpose of increasing elevation may be permitted if such can be <br />accomplished in a manner consistent with the policies of this SMP. <br /> <br />4. Fill shall be the minimum necessary to accomplish the use or purpose and shall be <br />confined to areas having the least impact to the stream corridor. Other alternatives <br />should be preferred over fill to elevate new homes in the floodplain, such as <br />increasing foundation height or zero-rise methods such as piers, posts, columns, or <br />other methods. <br /> <br />5. Fill in floodplains shall meet the requirements of Section 5.2 Environmental <br />protection and critical areas and Section 5.3 Flood hazard reduction. <br />
