BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br /> <br />RESOLUTION <br /> <br />NO. 2016 - ______ <br /> <br /> <br /> DECLARATION OF EMERGENCY – Event Center Meeting Rooms Water <br />Supply <br /> <br />WHEREAS: The Kittitas Valley Event Center Staff found that the water supplying the Grandstands <br />meeting rooms was not working; and <br /> <br /> WHEREAS: The Kittitas Valley Event Center having contracted users that were scheduled to use the <br />meeting facilities affected and with a limited time for the ability to relocate affected <br />contracted uses; and <br /> <br />WHEREAS: The Kittitas Valley Event Center Staff with assistance from the Kittitas County <br />Maintenance Department and City of Ellensburg Water Department, attempted to identify <br />the issue and make repairs; and <br /> <br />WHEREAS: Involved staff were unable to identify the issue; and <br /> <br />WHEREAS: the time urgency rendered the bidding process unusable; and <br /> <br />WHEREAS: The Kittitas Valley Event Center Director and Kittitas County Maintenance Director in <br />consultation, gave staff direction to contact a plumbing company to explore the issue and <br />make repairs; and <br /> <br />WHEREAS: declaring a State of Emergency, by which the Kittitas Valley Event Center is able contact <br />directly with a company capable of making the repairs as quickly as possible, is <br />necessary to meet contractual obligations to facility users. Justification falls under RCW <br />39.04.280 which allow for competitive bids to be waived in the event of the emergency <br />as defined under subsection 2(c) “For purposes of this section "emergency" means <br />unforeseen circumstances beyond the control of the municipality that either: (a) Present a <br />real, immediate threat to the proper performance of essential functions; or (b) will likely <br />result in material loss or damage to property, bodily injury, or loss of life if immediate <br />action is not taken.” <br /> <br />RESOLVED: That it is hereby declared that there is an emergency due to the urgent <br />need to make these repairs, and that the Kittitas Valley Event Center and Commissioners <br />are authorized to enter into contracts and incur obligations necessary to combat such <br />emergency to protect the health and safety of the community and property.
