meter only applies if you rely upon the RCW 90.44.050 exemption from permitting through <br />ecology. <br />Final approval of this plat shall be conditioned upon the Board of County Commissioners finding <br />that there exist adequate provisions for potable water. The application anticipates the use of an <br />"exempt well". In order for the Board to make a finding that such a provision is adequate, <br />evidence will need to be presented that the withdrawal falls within the exemption from <br />permitting found in RCW 90.44.050. A declaratory judgment by the Washington State <br />Department of Ecology stating that the anticipated withdrawal falls within the exemption will <br />create a presumption to that effect. <br />If the applicant obtains a permit under Chapter 90.44 RCW or water right transfer under Chapter <br />90.03 RCW, then final approval will not require the Board to make a determination that the <br />proposed withdrawal falls within the RCW 90.44.050 exemption but only that the water right is <br />sufficient to meet the needs of the proposed development. <br />This application does not contain sufficient information to make a determination of adequate <br />water availability or soil assessment to determine the land area is suitable for onsite sewage <br />systems.
