Tiger <br />Estates LLC was submitted later and that triggered DOE saying that a water right was <br />necessary. <br />Subsequently, I wrote to Melissa Downes of DOE on 10/22/08 (letter enclosed). Since <br />she never responded, I called her in November. She said she would review my letter with <br />her supervisor and they would get back to me. I have heard nothing. <br />In early January, I submitted Ms. Downes's 10/22/08 letter to Holly Duncan. Holly said <br />she would see what she could do to supply water for Wildcat and Tiger plats. Several <br />weeks later, she replied by phone that I would need to deal with DOE. On February 24, <br />2009, I wrote to Holly and asked her what the approval of Eagles Landing Short Plat and <br />Aztec Estates Plat meant in terms of water approved (see letter enclosed). To date I have <br />never heard anything definitive from her. <br />I am frustrated so I am appealing to you for some direction and help. Since the Mission <br />View Group B well is approved for six connections that should take care of the water <br />needs for Eagles Landing Short Plat. There are four existing connections to the Group B <br />well and there are three vacant lots in Eagles Landing. Lot D does not need water as that <br />lot is used as part of my house's property. That leaves lots A and B as future <br />connections. Mission View Well has been in the name of Mission View Well Users <br />Association since July of 1999 when the association opened a banking account at Sterling <br />Bank in Ellensburg. That well belongs to the members of Mission View Well Users <br />Association. <br />Aztec Estates Plat was approved for individual wells on 7 lots. One of the 7 (lot G) has <br />an existing well on it. <br />Wildcat Estates LLC Plat and Tiger Estates LLC Plat have 8 and 7 lots respectively. <br />Dave Nelson, as my registered agent, mistakenly submitted Wildcat before Tiger, <br />contrary to my instructions. <br />My question on a possible strategy: If we withdraw Wildcat Estates LLC and move <br />forward on only Tiger Estates LLC, will this likely satisfy DOE and Kittitas County in <br />their contention that I need a water right? Given the sequence of submittals mentioned in <br />paragraph 1 above, it appears that would be likely. If this is potentially a doable strategy, <br />06 <br />
