SCHULER, a Private Landowner, and FOWLER <br />CREEK TRUST, , based upon the following: <br />RECITALS <br />WHEREAS, JAMES K. SCHULER is the owner of that certain real property situate in <br />Kittitas County, Washington, and more particularly described in attached Exhibit A ; <br />and <br />WHEREAS, FOWLER CREEK TRUST, is the owner of that certain real property, situate in <br />Kittitas County, Washington commonly known as "The Property", and more particularly described in <br />attached Exhibit B (the "FOWLER CREEK TRUST); <br />and <br />WHEREAS, in connection with its development of the FOWLER CREEK TRUST, desires to <br />construct or cause to be constructed or located on the JAMES K. SCHULER Property the following: <br />Roads construction per Marion Performance Based Cluster Plat Approval by Kittitas County, all utilities <br />including sewer, water and power to serve all lots, herein referred to as the "Improvements'; and <br />WHEREAS, JAMES K. SCHULER and FOWLER CREEK TRUST, want to provide for an <br />easement for the construction and maintenance of the Improvements, and more particularly described in <br />attached Exhibit C <br />AGREEMENT <br />NOW THEREFORE, in consideration of the recitals, grants and covenants <br />contained herein and other good and valuable consideration, the receipt and sufficiency <br />of which are hereby acknowledged, the parties agree as follows: <br />1. Grant. JAMES K. SCHULER grants to FOWLER CREEK TRUST a perpetual, non- <br />exclusive easement <br />('Basement") for the Improvements on, over, in and under that portion of the JAMES K. SCHULER <br />Property described in attached Exhibit A . The foregoing Easement is for the benefit of and is appurtenant <br />to the JAMES K SCHULER and FOWLER CREEK TRUST Properties. <br />6N <br />X06 -D�7 <br />
