Marion PBCP <br />Response to Comments <br />1. KC Public Health <br />Issues: Water and Septic <br />Response: the applicant will meet the requirements of Kittitas County Public <br />Health Department and WA State Department of Health regarding Group water systems <br />and community septic systems. This was a condition of the MDNS that was not <br />appealed. <br />2. McFadden <br />Issues: Pollution from Septic systems <br />Canal Water Flow <br />Traffic <br />Hrs of operation <br />Ag -3 zoning <br />Response: The applicant required to meet the requirements of Kittitas County <br />Public Health Department and WA State Department of Health regarding Group water <br />systems and community septic systems. This was a condition on the MDNS, which was <br />not appealed. <br />Regarding Canal Water Flow the applicant is required by Kittitas County Code 16.18 to <br />supply a irrigation plan, for the proposed lots being created, if those lots are served by an <br />irrigation entity. <br />Regarding Traffic the applicant has completed a Transportation Impact Analysis (TIA) in <br />order to assess impact if any with regards to this proposal. This was not required by <br />County Staff nor part of the MDNS, but was provided by the applicant. Index number 89 <br />is the Section 7 Titled Conclusions of the TIA. Under this section it is stated that the <br />level of service at this site access point and other intersections is forecasted to remain at <br />or near a LOS -A and that the County's standard for rural roads is LOS -C, so no <br />improvements are necessary to mitigate impacts. <br />With regards to the Hours of operation. The applicant would suggest to the Hearing <br />Examiner that the hours of operation be adjusted to 8am to 5PM. <br />With regards to the Agricultrual-3 zoning. This project was submitted under this existing <br />zone. Ord. 2005-35, which the project is vested to, created the new Performance Based <br />Cluster Platting Code KCC 16.09. Under this code density bonus and clustering was <br />allowed as long as certain criteria was met. This proposal is consistent with and meets <br />the intent of this KCC 16.09 that was adopted pursuant to Ordinance 2005-35. <br />3.
