Docket 17-07: KCC Title 9 2017 | Page 7 of 17 <br /> <br /> <br /> (viii)The availability of a hearing if the owner of the dog objects to the declaration <br /> and submits a request for a hearing to the district court; <br /> (ix) If the court finds there is insufficient evidence to support the declaration, it <br /> shall be rescinded and the restrictions imposed thereby annulled. No court <br /> costs will be assessed against any Kittitas County officer or authority if the <br /> dog is not found to be dangerous. <br /> (x) If the court finds sufficient evidence to support the declaration, it shall impose <br />court costs on the appellant and may impose additional restrictions on the animal. <br /> (c) The owner of any animal found to be a dangerous dog under this Section shall be <br /> assessed all service costs under this Subsection. <br /> (d) The owner of any animal found to be a dangerous dog under this Section must keep <br /> animal control authority notified of the location of the animal at all times and must <br /> have the consent of the animal control authority to move the dog in or out of <br /> Kittitas County. <br /> (e) Following service of a declaration of potentially dangerous dog, and pending <br />appeals under this Chapter or to any other court with jurisdiction, the animal control authority <br />may, if circumstances require, impound the animal at the owner’s expense, pursuant to the <br />provisions of this Chapter, until a court orders either its redemption or destruction. <br /> (f) Any owner found to be in possession of a dangerous dog shall control <br /> the animal as under KCC 6.01.190. <br /> (g) All dogs that are found to be dangerous dogs shall be registered as under KCC <br />6.01.350. <br /> 4. All civil infractions under this section are subject to KCC 6.01.060. <br /> <br /> <br />ARTICLE II: REGISTERING AND LICENSING DOGS <br /> <br />6.01.110 Dog registration and license – Required. <br /> <br /> All adult dogs within the unincorporated area of the county shall be registered with and <br />licensed by the department or its designee at all times; provided, however, that a license issued <br />by other governments located in the county shall be valid under the provisions of this chapter <br />until the last day of December for the current year; and provided, further, that dogs kept in <br />kennels are licensed pursuant to this chapter shall be exempt from the provisions of this section. <br />Provided, further, that dogs kept at the Humane Society under RCW Chapter 16.52 shall be <br />exempt from licensing. All dogs kept at any humane society are required to be licensed upon <br />being sold or adopted. Any person guilty of a violation of this Section shall be fined one <br />hundred twenty-five dollars ($125.00) for each violation. <br /> <br />6.01.120 Dog registration and license – Application <br /> <br /> The person registering and licensing a dog shall submit to the department or its designee the <br />following information: <br />1. The name and the physical and mailing addresses of the owner of the dog being <br /> registered; <br />2. The name and the physical and mailing addresses of the person having custody of the
