at the applicable rate. Time shall be computed on a portal-to-portal basis. This section shall <br />not apply to Section 11.11 Court Time. <br />11.9.3 Callout: An employee who is required to report to work less than two (2) hours prior to the <br />beginning of a regularly assigned shift shall receive two (2) hours at the overtime rate of pay. <br />Said employee shall be allowed to complete the employee's regular scheduled shift. There <br />shall be no pyramiding of overtime. <br />11.9.4 Call-in: An employee called in on a scheduled day off shall receive a minimum of four (4) <br />hours pay at the overtime rate of pay. If over four (4) hours work the employee shall receive <br />actual time worked. <br />11.9.5 Meeting and Scheduled Events: Employees returning to work or coming in for a scheduled <br />event/training/meeting shall receive a minimum of two (2) hours pay at the applicable <br />overtime rate of pay. If over two (2) hours the employee shall receive actual time. <br />11.10 Compensatory Time Off: In lieu of payment for overtime, an employee may request compensatory <br />time off. Compensatory time may be carried forward from work period to work period to a <br />maximum accumulation of forty (40) hours. If it is necessary for the Sheriff to deny compensatory <br />time off at the requested time, due to manpower or other limitations, the employee shall be <br />entitled to payment for the compensatory time. Hours in excess of forty (40) per week as defined in <br />Section 11.9, shall be compensated for at time and one-half (1 %) in compensatory time off with the <br />approval of the Sheriff. <br />11.11 Court Time: Any employee who is required to appear and/or testify in court as a result of <br />circumstances which occurred in the line of duty on his own time or time other than his regular duty <br />hours shall be paid as set forth in Section 11.9 herein while in or awaiting court with a minimum of <br />two (2) hours' time worked. If the employee has not followed the court requirement verification <br />procedures set forth by the Sheriff, said employee will relinquish the employee's right to the time <br />worked. Nothing in this section is construed to require pay for time spent in personal suits, either <br />civil or criminal. <br />11.12 When an employee drives, travel time to and from any Employer -required authorized and assigned <br />school or training shall be considered hours worked in accordance with the Fair Labor Standards <br />Act. <br />11.13 The term "bona fide emergency" includes a life-threatening situation; civil disorder; natural disaster; <br />sudden unexpected happening; unforeseen occurrence or condition; complication of circumstances; <br />sudden or unexpected occasion for action; or pressing necessity. <br />11.14 Voluntary Overtime: The Sheriff will notify eligible employees of anticipated available overtime. <br />Assignment of such overtime will then be made by the Sheriff or designee. Assignment of overtime <br />shall be made upon the employee's preference and seniority, except in cases of emergency, or of <br />less than twenty-four (24) hours' notice.
