KITTITAS COUNTY <br /> DEPARTMENT OF PUBLIC WORKS <br /> PUBLIC WORKS—BOARD OF COUNTY COMMISSIONERS <br /> STUDY SESSION STAFF REPORT <br /> STUDY SESSION DATE: January 8, 2024 <br /> TOPIC: Bowers Field Land Lease <br /> i <br /> ACTION REQUESTED: Direct staff. <br /> LEAD STAFF: <br /> Joshua Fredrickson <br /> RECOMMENDATION: <br /> Direct staff regarding lease of lots within the aeronautical area which do not have taxiway <br /> access, and the lease term template. <br /> BRIEFING SUMMARY: <br /> • Bowers Field Airport Binding Site Plan 2"d Amendment recorded January 19, <br /> 2023, identifies four lots available for future development which do not have <br /> current access to the taxiway. <br /> • Land leases for development continues to be a source of revenue for Bowers Field <br /> • Lease template has been developed to include 30-year term with two 10-year <br /> extension options <br /> BACKGROUND: <br /> Bowers Field Airport Biding Site Plan 2"d Amendment (BS-21-00001) identifies lots <br /> within the aeronautical area of Bowers Field and the industrial park area that are available <br /> for lease. This includes four lots which do not have current access to the taxiway. <br /> Public Works met with representatives from the Federal Aviation Administration(FAA) <br /> regarding Bowers Field. FAA expressed concern over ground leases which extend <br /> beyond a 50-years term. Ground leases within the Aeronautical Area at Bowers Field are <br /> subject to FAA requirements, or grant assurances. Assurance 38 is specific to hangar <br /> construction. The FAA Order 5190.6B, Airport Compliance Manual states that leases <br /> exceeding 50 years raise issues with grant assurances and may be considered disposal of <br /> the property in that the term of the lease will likely exceed the useful life of the structures <br /> on the property. <br />
